OVERVIEW

This website is operated by D&D LEGACY GLOBAL LLC, a Florida limited liability company, doing business as Forastero ("Forastero," "we," "us," or "our"). Throughout the site, the terms "we," "us," and "our" refer to D&D LEGACY GLOBAL LLC and Forastero.

Forastero offers this website, including all information, content, features, tools, products and services available through it (collectively, the "Services"), to you conditioned upon your acceptance of these Terms of Service.

Our online store is powered by Shopify, which enables us to provide the Services and sell our products to you. Purchases made through our store are transactions directly between you and D&D LEGACY GLOBAL LLC.

By visiting, browsing, interacting with or purchasing through our website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not access or use the Services.

SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your state of residence or that you have permission from a parent or legal guardian.

You may be required to provide information such as your name, email address, billing information, payment information and shipping address. You agree that all information you provide is accurate, current and complete and that you are authorized to provide and use it.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not sell, transfer, assign or license your account to another person.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to display and describe our products accurately. Colors and appearance may vary depending on your screen, device and display settings.

Coffee is a natural agricultural product. Flavor, aroma and appearance may vary slightly between harvests, roast dates and batches. Tasting notes describe an expected sensory profile and do not guarantee that every person will perceive the same flavors.

Product descriptions, prices, packaging and availability may be updated without notice. We may discontinue a product or limit the quantities available to any person, household, geographic area or jurisdiction.

Coffee products are sold as whole bean unless a product page expressly states otherwise. Customers are responsible for reviewing the product description, weight, format, origin and tasting notes before purchasing.

Our products are intended for personal or household use. They may not be purchased for unauthorized resale, export or other commercial distribution.

SECTION 3 — ORDERS

Submitting an order is an offer to purchase. We may accept, decline, limit or cancel an order for reasons including product availability, suspected fraud, pricing errors, payment issues, unauthorized resale or an inability to fulfill the order.

An order is not accepted until payment has been successfully processed and we send an order confirmation. Receiving an automated confirmation does not limit our ability to cancel an order when a legitimate fulfillment or payment issue is discovered.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

Please review your order, email address and shipping address carefully before submitting it. Cancellation requests are handled according to our Returns & Refunds Policy.

SECTION 4 — PRICES, PAYMENTS AND TAXES

Prices, discounts and promotions may change without notice. The price charged will be the price displayed at checkout when the order is submitted.

Unless otherwise stated, product prices do not include shipping charges or applicable taxes. Shipping costs and taxes will be displayed at checkout before payment is completed.

Charges will appear on your bank or card statement as SP FORASTERO.

You agree to provide current, complete and accurate billing, payment and account information. You represent that you are authorized to use the payment method submitted and agree to pay all charges associated with your order.

Promotions may have separate eligibility requirements, expiration dates or terms. If promotional terms conflict with these Terms, the specific promotional terms will control for that promotion.

Prices offered online, at pop-ups, at events or through third-party sales channels may differ.

SECTION 5 — SHIPPING AND DELIVERY

We currently ship to valid addresses within the United States, including Washington, D.C., PO Boxes and APO/FPO military addresses. We do not currently offer international shipping.

Processing and delivery dates are estimates. Delays may occur because of carrier operations, weather, address issues, high order volume or events outside our reasonable control.

We will provide tracking information when available. Customers are responsible for monitoring tracking and providing a secure delivery location.

If an order is delayed, lost, damaged, marked as delivered but not received, or returned because of an address problem, it will be handled according to our Shipping Policy and our Returns & Refunds Policy.

Nothing in this section limits any cancellation or refund rights provided by applicable law.

SECTION 6 — RETURNS, REPLACEMENTS AND REFUNDS

Coffee is a consumable food product and cannot be returned or placed back into inventory after shipment.

Returns, replacements, courtesy coffee exchanges and refunds are governed by our Returns & Refunds Policy, including The First Bag Promise.

If these Terms conflict with our Returns & Refunds Policy regarding a return, replacement or refund, the Returns & Refunds Policy will control for that issue.

SECTION 7 — EVENTS AND COFFEE SERVICES

Information displayed on this website about private events, corporate events, weddings, pop-ups, collaborations, coffee cart services or other experiences is provided for general informational and inquiry purposes.

Submitting an inquiry does not reserve a date or create a binding agreement. Event availability, pricing, menu, guest count, service duration, staffing and other details must be confirmed in a separate written proposal or service agreement.

Event bookings may require a deposit and will be governed by the cancellation, payment and service terms stated in the applicable proposal or agreement.

SECTION 8 — INTELLECTUAL PROPERTY

The Services and their contents — including the Forastero name, logos, illustrations, packaging, product names, photographs, videos, text, graphics, designs, slogans, website layout and other creative materials — are owned by or licensed to D&D LEGACY GLOBAL LLC and are protected by applicable intellectual property laws.

The Forastero name, visual identity, product names, designs, illustrations and slogans may constitute trademarks, trade dress or other intellectual property, whether registered or unregistered.

You may access and use the Services for personal, noncommercial purposes. You may not reproduce, distribute, modify, publish, display, sell, license, create derivative works from or commercially exploit any part of the Services without our prior written permission.

Nothing in these Terms grants you ownership of or a license to use our intellectual property except for the limited personal access expressly described above.

Shopify's names, logos, products and services are the property of Shopify or its licensors.

SECTION 9 — THIRD-PARTY TOOLS AND LINKS

The Services may provide access to tools, applications, payment systems, embedded content or websites operated by third parties.

We do not control and are not responsible for the content, accuracy, availability, privacy practices or services of third parties. Your use of third-party services may be subject to separate terms and policies.

Review the applicable third party's terms and policies before completing a transaction or providing personal information.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify, which provides the ecommerce technology used to offer the Services.

Purchases made through our store are transactions directly between you and D&D LEGACY GLOBAL LLC. Shopify is not the seller of our products and is not responsible for the products, fulfillment, customer service or any loss arising from a purchase from Forastero.

To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from transactions between you and Forastero.

SECTION 11 — PRIVACY

Personal information collected through the Services is handled according to our Privacy Policy.

Because Shopify hosts our store, Shopify may collect and process information related to your access to and use of the Services. Information may also be shared with payment processors, shipping providers and other service providers needed to operate the store and complete your order.

SECTION 12 — REVIEWS, FEEDBACK AND USER CONTENT

If you submit a review, photograph, comment, suggestion, idea or other content to us, you represent that you own or have permission to provide that content and that it does not violate another person's rights.

You grant D&D LEGACY GLOBAL LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, publish, display, adapt and distribute submitted content for operating, improving and promoting Forastero and the Services.

This permission does not transfer ownership of your content to us.

You may not submit content that is unlawful, misleading, defamatory, abusive, obscene, infringing, malicious or harmful to the Services or another person.

We may moderate, refuse or remove submitted content at our discretion, but we are not obligated to monitor all user content.

SECTION 13 — ERRORS AND AVAILABILITY

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions involving product descriptions, pricing, promotions, shipping charges, transit times or availability.

We may correct errors, update information or cancel affected orders. If we cancel a paid order because of an error or availability issue, we will issue a refund to the original payment method.

We are not obligated to update information except as required by law.

SECTION 14 — PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

Violate any applicable law or regulation.
Infringe our intellectual property or the rights of another person.
Submit false, fraudulent, misleading, abusive or unlawful information.
Harass, threaten, impersonate or harm another person.
Transmit malware, viruses or harmful code.
Collect personal information about others without authorization.
Send spam, phishing messages or unauthorized promotions.
Circumvent security features or access restrictions.
Scrape, copy, resell or commercially exploit the Services without permission.
Interfere with the operation or security of the website.

We may suspend or terminate access if we reasonably believe these Terms have been violated.

SECTION 15 — TERMINATION

You may stop using the Services at any time.

We may suspend or terminate access to the Services if you violate these Terms, misuse the website, engage in fraud or create a security or legal risk.

Termination does not affect payment obligations or rights that arose before termination. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, indemnification and governing law — will remain in effect.

SECTION 16 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that the website will always be uninterrupted, secure or free from errors. We may temporarily suspend access for maintenance, updates or circumstances outside our reasonable control.

Any warranties that cannot legally be excluded remain in effect. Nothing in these Terms excludes rights or remedies that cannot be waived under applicable law.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, D&D LEGACY GLOBAL LLC, Forastero and their owners, officers, employees, contractors, service providers and licensors will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Services or purchase of products.

This includes loss of profits, revenue, data or business opportunities, even if we were advised that such damages were possible.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct or other liability protected by applicable law.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless D&D LEGACY GLOBAL LLC, Forastero, Shopify and their respective owners, officers, employees, contractors, service providers and licensors from third-party claims arising from:

Your material violation of these Terms.
Your unlawful use of the Services.
Your violation of another person's rights.

We will provide reasonable notice of an indemnifiable claim and may participate in its defense.

SECTION 19 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or removed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with the policies and rules referenced in them, constitute the entire agreement governing your use of the Services and replace prior communications concerning the same subject.

SECTION 21 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets or other lawful business transfer.

SECTION 22 — GOVERNING LAW AND VENUE

These Terms and any separate agreement through which we provide the Services are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent permitted by law, any legal proceeding arising from these Terms or the Services must be brought in the state courts located in Broward County, Florida, or in the federal courts having jurisdiction over Broward County.

Nothing in this section prevents either party from bringing a claim in small claims court when eligible.

SECTION 23 — CHANGES TO THESE TERMS

We may update these Terms from time to time by posting a revised version on this page and updating the "Last updated" date.

Material changes will apply prospectively and will be communicated when required by law. Your continued use of the Services after an updated version becomes effective constitutes acceptance of the revised Terms.
